c Terms of Use — Dr Mark

Terms of Use

Effective October 28, 2026

These Terms of Use (“Terms”) govern your use of Dr Mark (the “App”) and this website, provided by Vivien Roggero LLC (“we”, “us”). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Mac computers you own or control, for personal or commercial purposes, in accordance with these Terms.

If you obtained the App from the Mac App Store, your use is also governed by Apple’s Licensed Application End User License Agreement (the “Apple EULA”). If these Terms conflict with the Apple EULA, the Apple EULA prevails for App Store copies.

2. Restrictions

You may not copy, modify, reverse engineer, decompile or disassemble the App except as permitted by law; rent, lease, sell or redistribute it; remove proprietary notices; or use it in violation of any law.

3. Your content

You own the documents you create or edit with the App. We do not claim any rights to them and do not have access to them. You are responsible for your content and for keeping backups of your files.

4. AI features and third-party services

The App’s optional AI features connect to third-party providers (such as NVIDIA, Google, OpenAI or Anthropic) or to a local model server, using API keys you supply. Your use of those services is governed by their own terms and policies, and you are responsible for any fees they charge.

AI-generated output can be inaccurate, incomplete or inappropriate. Review it before relying on it. We are not responsible for third-party services or for content they generate.

5. Updates

We may release updates that add, change or remove features. These Terms apply to all updates unless an update comes with separate terms.

6. Intellectual property

The App, its design, code, name, logo and documentation are owned by Vivien Roggero LLC and protected by intellectual property laws. Except for the license above, no rights are granted to you.

7. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be error-free or uninterrupted, or that it will never lose or corrupt data.

8. Limitation of liability

To the maximum extent permitted by law, Vivien Roggero LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or business, arising from your use of or inability to use the App. Our total liability for any claim will not exceed the amount you paid for the App in the twelve months before the claim, or US$50 if you paid nothing.

Some jurisdictions do not allow these exclusions or limits, so they may not fully apply to you.

9. Termination

Your license ends automatically if you breach these Terms. You may stop using the App at any time by deleting it. Sections 3, 6, 7, 8 and 10 survive termination.

10. Governing law

These Terms are governed by the laws of the state in which Vivien Roggero LLC is organized, without regard to its conflict-of-law rules, except where the law of your country of residence requires otherwise.

11. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new effective date. Continuing to use the App after a change means you accept the updated Terms.
